Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you and KitBank PLC ("KitBank," "we," "us") governing access to and use of the KitBank website, mobile applications, APIs, agent tools, and all financial and insurance products offered through our platform (collectively, the "Services").

These Terms apply to personal and business customers, authorized agents, and any person who accesses the Services. Supplemental terms may apply to specific products (e.g., insurance policies, crypto trading); those terms are incorporated by reference where applicable.

By clicking "I agree," registering an account, or continuing to use the Services, you confirm that you have read, understood, and accept these Terms and our Privacy Policy. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.

• You must be at least 18 years of age (or the age of majority in your jurisdiction).
• You must reside in or be authorized to use Services in a supported jurisdiction.
• You must not be subject to sanctions or listed on any prohibited persons list.
• You must not have been previously suspended or terminated from KitBank Services.

You agree to provide accurate, current, and complete information during registration and Know Your Customer (KYC) verification. You are responsible for maintaining the confidentiality of your credentials, PIN, OTP codes, and devices. Notify us immediately of unauthorized access.

KitBank may request additional documentation, perform ongoing due diligence, and refuse or close accounts that fail verification or present unacceptable risk.

Services are provided for lawful personal or business banking purposes only. You agree to comply with all applicable laws, regulations, and KitBank policies. We may modify, suspend, or discontinue features with reasonable notice where practicable.

KitBank does not provide legal, tax, or investment advice unless explicitly stated in a separate advisory agreement.

Fees for transfers, FX, card usage, loans, insurance premiums, agent-assisted transactions, and other Services are disclosed in-app, on our fee schedule, or at the point of transaction. We may change fees in accordance with applicable notice requirements. You authorize KitBank to debit applicable fees from your account.

You are responsible for verifying payment details before confirmation. Once authorized, many transactions cannot be reversed. KitBank is not liable for losses resulting from incorrect recipient details provided by you, except where required by law or our error.

We may delay, block, or investigate transactions to comply with AML/CTF obligations or fraud prevention controls.

Credit products, loans, and insurance policies are subject to separate product terms, underwriting approval, and regulatory disclosures. Premiums, interest rates, and coverage limits are as stated in your offer or policy documents. Failure to pay premiums or loan obligations may result in default, cancellation, or collection action permitted by law.

If you use a KitBank authorized agent for cash-in/cash-out, registration, or insurance assistance, you acknowledge that agents act within KitBank's framework. Agents must not request your password or PIN. KitBank is not responsible for offline arrangements between you and unauthorized third parties posing as agents.

Cryptocurrency and digital asset services involve significant volatility and risk. Values may fluctuate rapidly; you may lose some or all of your investment. KitBank does not guarantee returns. You are solely responsible for tax reporting related to crypto activity where applicable.

All trademarks, logos, software, content, and materials on the Services are owned by KitBank or its licensors. You receive a limited, non-exclusive, revocable license to use the Services for personal or authorized business use. You may not copy, reverse engineer, or exploit our intellectual property without written consent.

You agree not to:

• Use Services for fraud, money laundering, terrorism financing, or illegal activity;
• Circumvent security measures or access another user's account;
• Transmit malware, scrape data without permission, or overload our systems;
• Impersonate KitBank, our staff, or other users;
• Use Services in a manner that harms KitBank, other users, or third parties.

We may suspend or terminate your access immediately for breach of these Terms, legal requirements, or risk concerns. You may close your account subject to settlement of outstanding obligations. Provisions that by nature should survive termination (including liability limits and dispute resolution) will survive.

Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. KitBank disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, KitBank and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Services.

Our aggregate liability for direct damages shall not exceed the greater of (a) fees you paid to KitBank in the twelve (12) months preceding the claim, or (b) one hundred (100) USD equivalent, except where liability cannot be limited under applicable consumer protection law.

You agree to indemnify and hold harmless KitBank from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or violation of applicable law.

Before initiating formal proceedings, you agree to contact us at [email protected] to attempt informal resolution. Where permitted, disputes may be resolved through binding arbitration or competent courts as specified in your jurisdiction's account agreement.

These Terms are governed by the laws of the jurisdiction in which KitBank PLC is incorporated and licensed, without regard to conflict-of-law principles, except where mandatory local consumer laws apply.

We may update these Terms from time to time. Material changes will be notified via email, in-app notice, or website posting. The "Last updated" date reflects the latest revision. Continued use after the effective date constitutes acceptance.
